Frequently Asked Questions

A will ensures your assets are distributed according to your wishes and provides security for your loved ones after you pass away.   At its simplest, a Will distributes your estate to beneficiaries without any protective measures.

A Will Trust is a Will which includes a protective trust to come into effect when you die.  This serves to ensure that your assets are ringfenced from a spouse remarrying after you die (sideways disinheritance)  or other potential claimants to your estate (estranged family members or care fees assessments).

Yes, you can, a Living Property Trust can do this but it is not to be viewed as a way to save on inheritance tax as this is what most people believe. The reasons you would utilise a Property Living Trust is to take it out of your estates so that it is ringfenced from third party assessments. It also ensures that on death the property can pass straight to beneficiaries without going through probate.

You can appoint a trusted individual, such as a family member or friend, to make decisions on your behalf if you’re unable to do so.

Probate is the legal process of validating a will and distributing assets. The duration depends on the estate’s complexity, usually taking several months.
